Determining Jurisdiction
Under the Class Action Fairness Act of 2005, most class action lawsuits must be heard in federal courts. This law laid out specific guidelines for state jurisdictions. According to the law, the following conditions are necessary for a state to have jurisdiction over a class action lawsuit:
- The plaintiffs must seek less than $5 million in damages
- Two-thirds of the plaintiffs must reside in the same state
- The defendant must be from the same state as the majority of plaintiffs
