Consumer Warranty Violations
For expensive or important purchases, many consumers will want to purchase a product that also has a reliable warranty. Many manufacturers and retailers now include warranties with their products to reassure customers that they are buying a good product backed by quality customer service.
However, a warranty is only as good as the company that stands behind it. Sometimes, the business that promised a warranty violates its own guarantee, cheating the customer and failing to replace or repair a defective or damaged product. When a company fails to meet the terms of its warranty, it may be held legally liable for consumer fraud.
Types of Warranty Violations
Warranties are often purchased as an extra cost on top of the cost of a product, and when a company fails to meet the terms of its warranty, the consumer is likely entitled to a refund for the warranty and the defective product. There are many different ways that a company may violate a warranty agreement, such as:
- Claiming that you do not qualify for the warranty. A company may try to convince a consumer that their warranty is void because of something they did or did not do. However, the company may be ignoring its own warranty terms and may be making excuses to avoid having to replace or repair the item.
- Acting in bad faith. A company may make it exceedingly difficult for you to get your item replaced or repaired in order to discourage you from taking advantage of the warranty.
- Failing to address the issue in a timely manner. Even if a company agrees to accept a defective item under the warranty, they may delay repairing or replacing it, or may eventually ship it back to you without making the required repairs.
If a manufacturer or retailer has committed any of these warranty violations, you may be entitled to a full refund for the cost of your warranty, the defective product, and shipping expenses.
