What is a Representative Plaintiff?
Unlike normal personal injury lawsuits, class action lawsuits involve a group of people all suing the same person or entity because a product or act directly caused a similar type of harm to each of them. Because of the large difference between a class action and personal injury lawsuit, there are some terms and conditions many people are not aware of. For example, class action lawsuits have a representative or lead plaintiff who actually steps in to represent the entire group.
If you have suffered because of the actions or inaction of another person or entity, you may be eligible to file a class action lawsuit with others who have suffered similar harm. Responsibilities of a Representative Plaintiff
In order to file a class action lawsuit, one or more parties can file the lawsuit on behalf of the entire class of people who were harmed. If there are multiple actions filed, the court will typically aggregate the actions into one claim. Once this happens, the court will select one or even a few members of the lawsuit to represent everyone else in the class.
These selected few are referred to as the representative plaintiffs. Some actions these individuals are responsible for are:
- Directing any action
- Overseeing counsel
- Speaking on behalf of the group
