A class action lawsuit has been filed on behalf of the AT&T at home virtual call center employees that claim that they were mislabeled as independent contractors so that the company could get around California’s wage and hour laws.

In the California Labor Code, the minimum wage rules, overtime laws and lunch break requirements do not stand for independent contractors.

This complaint alleges that AT&T created a scheme to mislabel these at-home workers so that they could avoid paying state and federal taxes as well as worker’s compensation benefits. The at-home call center employees provide technical support for AT&T customers.

Former funeral director charged with insurance fraud

A former funeral director in Southern Indiana has plead guilty to two charges of insurance fraud and he was charged with another four.

He plead not guilty to four charges and is hoping that they will be removed from his record. Under the plea, the man will be sentenced to four years for each charge and two years suspension for each.

The man was accused of delivering fake remains to families and defrauding them. The man faces 60 other charges that are related to his work at the funeral home.

Accounting firm accused in mortgage fraud scheme

The owner of an accounting firm in Las Vegas was arrested after allegedly running a scheme on mortgage fraud in the area.

The 51-year-old man was charged with two counts of wire fraud after he allegedly thought of a scheme to defraud financial institutions.

According to the charges, the man would allegedly apply for and push buyers to apply for mortgage loans after using false information about assets, income and the intent to occupy the homes. He could face 2o years in prison and fines of $250,000 for each charge if he is convicted.

Lawsuit filed against GM seeks class-action status

A Pennsylvania woman recently filed a lawsuit against General Motors Co. which alleges that the company failed to inform consumers of a problem with their 2007 and 2008 Chevrolet Impalas.  The lawsuit also accuses GM of breech of warranty.

In addition, the lawsuit, which seeks class-action status, states that the automobile manufacturer fixed the problem on approximately 24,000 Impalas used by police departments, but not those bought by civilians.

 The woman suggests that GM should repair the problem on all 423,000 Impalas sold by the company to civilian drivers.

The 2007 and 2008 Chevrolet Impalas were found to have defective spindle rods that misalign the vehicles’ wheels and causes increased wear on the back tires.  According to the lawsuit, GM was aware of the defect and instructed dealers to fix the defect on police vehicles and reimburse police departments for rear tires that had already been replaced.

Sony sued by Star Wars Galaxies subscribers

Sony Online Entertainment along with LucasArts have announced that the game, Star Wars Galaxies MMORPG, will be shut down in mid-December due to multiple issues.

These issues include the end of the licensing agreement, competing with other MMORPG’s and other declining subscriptions. This announcement angered many subscribers and nearly 2,500 of them have signed a petition.

This petition offers options that will keep the MMORPG alive.  The first change would be to make the game free to play and allow some content available for purchase. Officials have also stated that this petition is not enough and some SWG users are joining together in order to file a class action lawsuit.

The lawsuit was filed to prevent the company from shutting down the game, but the company had an end-user license agreement that all users had to sign before playing.

Wal-Mart class action ruling may change lawsuits against corporations

al-Mart class action filed by employees that stated that the corporation treated workers unfairly has ended with the court stating that the group of employees was too large to sue for a discrimination class action lawsuit.

According to the 5-4 decision, Wal-Mart may be too massive to sue. This decision has possibly ended what would have been the largest gender biased class action lawsuit in history.

This class action lawsuit covered more than 1.6 million women who worked or used to work at Wal-Mart and they were fighting for wage equity and chances to move up the management ladder. The court found that there was not enough evidence to prove that Wal-Mart had a standard of evaluation for its workers at each of its 4,000 stores.

Class action against Best Buy ends in $200 thousand settlement

A class action lawsuit against Best Buy has now been settled for $200, 000. The 6-year-old discrimination case accused Best Buy of not promoting women or minorities or offering them desirable jobs.

The legal bills in the case reached nearly $10 million and Best Buy will be covering the charges. The company has also pledged that they will make it easier for women and minorities to have access to these jobs and to have diversity in their management ranks.

Class action status approved in Bayer case

Two West Virginians have been cleared by the U.S. Supreme Court to seek a class-action lawsuit against Bayer for its cholesterol drug, Baycol.

Baycol was withdrawn from the market in 2001 after it was l

School involved in class action lawsuit

The Richmond School of Health and Technology has recently been involved in a class action lawsuit. The school has two campuses in the Richmond area.

The class action lawsuit alleges that the school is a “sham” and that its only goal is to make money and it does not properly prepare students for careers in the chosen fields or for their licensing examinations.

The civil rights lawsuit claims that the school looks for minorities in order to collect loans from the federal government, but the students are enlisted to programs that are not helpful.

The suit claims that this targeted enrollment has lead to student body made up of 75 percent black students even though the African American population in the area is only 30 percent.

AT&T class action results in $956 million refund

After a $956 million settlement that was determined after a class action lawsuit, AT&T has the task to reimburse customers that were taxed for their internet use.

The class action lawsuit claimed that the company violated the Internet Tax Freedom Act, which bans taxing on the internet use. The tax refunds will now have to be dispersed between all customers that were taxed, which is about 32 million customers.

AT&T denies any wrongdoing in the case and has said that they have stopped charging some fees and taxes on their data plans.
